Emmett Albergotti says that he has filed a lawsuit against San Diego County and Caltrans after he was hurt in a bike crash over a year ago. He says he still feels the effects of the injuries he sustained and hopes that his suit will prevent others from going through what he has experienced.
Albergotti says that on March 10, 2018, he was riding his bike in the bike lane on Champagne Boulevard when he swerved to avoid hitting a clump of pavement that was in the roadway. When he swerved, his bike flipped and he crashed onto the street. He broke nine ribs and was in the hospital for three days.
When you need a San Diego bicycle accident attorney, you can count on Edward “Skip” Babbitt to be by your side. He understands these types of crashes and will fight to ensure that you get all of the compensation you deserve.
What Happened Here?
“There were no workers, no trucks, no cones, no signs, nothing that made us aware there was any dangerous condition what so ever,” says Albergotti. The crash happened just past construction zone signs where he thought he would be riding in an improved lane. It turns out, the construction was not over.
“The truth is, I still haven’t recovered. My injuries are still limiting as to what I can do,” he says.
The truth is that there are many causes of bicycle accidents and one of them is negligence on the part of those responsible for maintaining the roadways. A pothole or clump of cement may not seem like a big deal for a passenger vehicle, but for a bicyclist, it can mean life or death.
We also know that negligent drivers pose a risk to bicyclists. For the latest reporting year in California, there were:
- 147 bicyclist fatalities
- 11,634 bicyclist injuries
The injures victims sustain in bicycle accidents are often severe and can include the following:
- Spinal cord injuries
- Head injuries/traumatic brain injuries
- Broken and dislocated bones
- Internal bleeding/organ damage
- Severe lacerations
The cost of care for these injuries can be tremendous and long-lasting. In Mr. Albergotti’s case, like many others injured in bicycle crashes, the pain and suffering lingers for years. The negligent driver and those responsible for roadway maintenance need to be held responsible for damages and injuries.
