When Trevor Heitmann crashed his McLaren into another vehicle on Interstate 805 last year, killing a mother and daughter, the country was watching. That is because Trevor Heitmann had gained fame as a YouTuber. Video evidence suggests that Heitman never attempted to avoid the crash. He didn’t have any alcohol or drugs in his system and had no history of mental illness.
However, the police had been at his house earlier that day about nine hours before the deadly crash. A family friend reported to police that Heitmann was “screaming, paranoid and delusional” and had threatened harm to his mother. The family friend urged police to get help for Heitmann.
Unfortunately, they never did. Now, a lawsuit has been filed for negligence.
Edward “Skip” Babbitt understand that there is often confusion surrounding a death. If you think that you may need a wrongful death attorney in San Diego, you can count on Skip to be by your side, working to uncover the truth.
What Happened that Day
Police did respond to the family friend’s call. They showed up at the Heitmann family home and spoke to Trevor Heitmann’s father. Apparently, the father told police that his son would become violent if officers tried to convince him to seek mental health treatment and that he would take his son to the doctor later that day.
Trevor Heitmann’s parents had blocked Heitmann’s McLaren in with their own vehicle so he could not use it, but he rammed the vehicle and got out of the driveway anyway. By 4:30, he was dead, along with Aileen Pizarro and her daughter Aryana, victims of the fiery car crash.
The family’s lawsuit for negligence has been filed against the SDPD and the county’s Psychiatric Emergency Response Team. The family does not believe that the police handled their response to initial concerns about Heitmann’s behavior appropriately.
While this case is one of negligence, it could easily become a wrongful death claim. While we wait to see how this case plays out, we want to let you know some of the other common ways in which wrongful death cases arise:
Excessive Police Force
These examples are by no means that only way in which these cases arise. You should always speak with a qualified attorney when deciding whether or not to move forward with your particular concerns.
